ARGUILLES , of legal age, Filipino, married and a resident of L Street, 9 th  Road, Hermilinda Homes, Mansilingan, Bacolod City, after having been duly sworn to in accordance with law, do hereby depose and state: PRELIMINARY STATEMENT That the examination for this judicial affidavit was conducted by the undersigned counsel at his office at St. Bartholomew Extension Street, Dona Juliana Subdivision, Taculing, Bacolod City. That I am answering the questions herein fully conscious that I do so under oath, and that I may face criminal liability for false testimony or perjury. PURPOSE OF THE TESTIMONY The purpose of the testimony of the herein witness is offered to prove that he is the petitioner in this case; to prove the material allegations contained in the complaint of RUEL M. ARGUILLES, Petitioner, -versus- CIVIL CASE NO. 17-2520 FOR: DECLARATION OF NULLITIY OF MARRIAGE MYRA P. NIVADURA, Respondent.  x-------------------------x    Page 2 of 6 this case; and for him to testify on the relevant circumstances of the case such as his present residence, his meeting with the defendant, courtship, marriage and other related and relevant matters. DIRECT EXAMINATION Q1:   Mr. Witness, are you the Ruel M. Arguilles, Petitioner in Civil Case No. 17-2520, entitled Ruel M. Arguilles, Petitioner, versus Myra P. Nivadura, Respondent, for Declaration of Nullity of Marriage? Yes, I am the same Ruel M. Arguilles, Petitioner in the said case. Q2:   In relation with the said case, do you remember having caused the preparation of a Petition? Yes, Sir. Q3:   If the said Petition be shown to you, would you be able to identify the same? Yes, Sir. Q4:   Do you know Myra P. Nivadura, Respondent in this case? Yes, she is my wife. Q5:   Can you show anything to this Honorable Court to prove that you and said Respondent are married? Yes. I have attached a copy of our Certificate of Marriage to the petition filed before this Honorable Court and the same was marked as Annex “C” to the petition. Q6:   Do you have the srcinal of the said Certificate of Marriage? Yes, here it is.    Page 3 of 6 Q7:   Do you warrant that the machine copy attached to the Petition is a true and faithful reproduction of the srcinal? Yes, Sir. Q8:   Mr. Witness, when and where were you married? On June 18, 1997 at 22 nd  Gen. Luna Street, Caloocan City. Q9:   Do you and the Respondent have children? No. We don’t have children.   Q10:   When and where did you and Respondent meet? As I remember, that was nearly end of 1995 when I first met Respondent in BPI Megamall Branch. Q11:   How did you and Respondent meet? We work in the same company as bank tellers, but her branch was in BPI Megamall Branch and mine was in Mandaluyong branch. I was then a roving teller and I would normally go to different BPI branches to pick up and deliver cash deposits. Q12:   What were your impressions of Respondent during your first meeting? At first I thought of her as a nice, simple and caring woman. Q13:   How long were you and Respondent dating before you got married? 18 months. Q14:   Did you have pre-marital sex with your spouse? Yes, we did. A few times.    Page 4 of 6 Q15:   What were your expectations of your marriage? I am not really sure, but all I know is that during that time, both of us dreamed of being successful in our chosen careers. Q16:   How would you describe your honeymoon? We did not celebrate it. Q17:   Where did you stay after your wedding? Actually, both of us asked for a half day at work, so we could get married in the afternoon. After the celebration, we just went together to eat at a restaurant and then we went our separate ways after that. Q18:   How would you describe your relationship as husband and wife? We actually kept our marriage a secret because we do not want anyone to know that we were already husband and wife. We just acted like we were still boyfriend and girlfriend. Q19:   How would you describe your wife? She is like any normal person who loves her job and likes to go to church every time she gets off from work.   Q20:   How are you as a husband? After the marriage, we actually did not live together as husband and wife. She lived with her parents and I lived with my mom and siblings in Caloocan City. Q21:   You said that you were not able to live together as husband and wife at all. What do you mean by this? Q22:   You also said that you kept your marriage a secret. Why is that so?
