Legal search developed in the late 1960’s, in response to the legal community’s demand for specialized consulting services in the hiring of attorneys. The industry increased dramatically through the decades. The field expanded quickly, yet dialogue among legal search consultants was virtually nonexistent. In addition, there was little or no focus on ethical practice within the business. The credibility of legal search firms among the legal and business communities was inconsistent due to the tremendous variation in standards of practice. Thus the National Association of Legal Search Consultants was founded in 1984. GOALS NALSC® was founded by a group of the nation’s leading legal search consultants whose primary goal was elevating the professionalism of the field by establishing a Code of Ethics. In addition to this goal, NALSC® is dedicated to: Raising the image of the legal search profession through a national public relations effort; Providing education and information on trends and issues in the industry. ANNUAL CONFERENCE, SEMINARS & SYMPOSIUMS NALSC® activities include producing an Annual Conference, Seminars, and Symposiums on subjects of vital interest to the legal recruitment industry. These events feature key speakers from law firms, corporations, private entities, recruitment firms and related organizations. Formats encompass speakers, panels, interactive round-table discussions, town hall meeting, and more. Rounding out the continuing education element of the conference, there are also networking receptions planned as well. 4 About NALSC®, continued ARBITRATION SERVICE An arbitration service has been established by NALSC® to facilitate the resolution of disputes between member firms and other member firms. Based on the American Arbitration Association rules and procedures, this service utilizes NALSC® members as arbitrators. NEWSLETTER The NALSC® newsletter, distributed electronically to members, features timely articles of interest to the legal search community including news items and information concerning the Association’s activities. WEBSITE NALSC® offers an informative and interactive website. The site features the most current issue of the newsletter, updates on current NALSC® events and a complete membership listing with direct links to members’ websites. In early 2002, NALSC® launched a revitalized website. The site includes a Members-Only section with access to enhanced features. ASSOCIATE MEMBERS NALSC® is pleased to acknowledge its Associate Members, a group of members made up of suppliers vital to our industry. The NALSC® Associate Membership category includes legal publications, vendors and other sponsors of NALSC® events. SUPPORTING LAW FIRM MEMBERS Law firms nationwide show their support for NALSC® and its continuing enforcement of the NALSC Code of Ethics® by becoming Supporting Members of the Organization. To that end, its members have established this Code of Ethics, subscribed to and endorsed by all as conditions of his or her continuing membership. ARTICLE I Relations With Employers 1. Information provided to employers shall be the most accurate information known to the search firm. 2. No search firm shall withhold candidate information, which the employer would reasonably consider essential to its hiring decision. 3. Candidates shall be referred only (i) with prior authorization of the employer or (ii) where the search firm, based on previous direct communication with the employer, reasonably believes the employer would accept the referral. 4. Confidential information relating to the employer shall be treated accordingly. 5. Fee obligations and replacement and refund provisions, if any, shall be provided to the employer prior to the referral of candidates. 6. No search firm shall recruit any attorney from the office of an employer in which it has made a placement for a six-month period following that placement, unless the search firm reasonably believes such a restriction is not required by the employer. 7. No search firm shall recruit a candidate it has placed while that candidate remains with the employer that paid the recruiting fee. ARTICLE II Relations With Candidates 1. Information provided to candidates shall be the most accurate information known to the search firm. 8 2. No search firm shall withhold employer information, which a candidate would reasonably consider essential to his or her hiring decision, subject to the search firm's duties to the employer. 3. Candidates shall be referred to employers only with the candidates' express prior consent. 4. A search firm shall treat as confidential all information supplied to it in confidence by a candidate, subject to the search firm's duties to the employer. 5. Search firms shall make all referrals, which have been authorized by the candidate and shall inform the candidate of the results of those referrals in a timely manner. 6. No search firm shall attempt to exert undue influence on the candidate. ARTICLE III Relations Among Members 1. Members of this Association shall relate to each other in a professional and ethical manner consistent with the goals of this Association. 2. While competition among search firms is encouraged, no member shall seek an unfair advantage against its competitors. 3. Except for fee-sharing agreements between search firms, no member shall make payments of any kind to gain business referrals or to induce others into a relationship as a client or candidate. 4. Members shall recognize and not interfere with
