City spokeswoman Pam Roman said the Department of Parks, Recreation and Community Services notified the organization Monday that no additional payments will be processed until all performance standards of the contract have been met. The $1 million contract awarded to the nonprofit sets specific fundraising goals before it can receive installment payments from the city. The city has since Sept. 1, the effective date of the agreement, made payments to the group totaling $450,000: an initial payment of $300,000 and a $150,000 payment on Dec. 1. The $150,000 scheduled to be paid March 1 will not be transferred until the Friends reaches the $100,000 mark. Friends board member and fundraising chair Bill Prescott said Tuesday the group is close to getting a grant and cited “midMarch” as the time frame. “We just have to wait,” he said. “We’re confident a grant will come in.” Board President Wayne Wood said the March 1 deadline was “purely a benchmark” and there is nothing wrong with the city withholding further contributions until the terms of the agreement are met. Prescott agreed. He said the group hasn’t been spending the $450,000 already received as fast as it anticipated. All of the more than 960 guest rooms will be remodeled from floor to ceiling, including new furniture and fixtures. The Regency Club lounge also will be renovated, as will the rooftop fitness center. Six meeting rooms will be added on the fourth-floor of the hotel’s Terrace Building. Refrigerators and safes will be installed in all guest rooms. Brown received 37 percent of the vote among 546 likely voters the school polled Feb. 23-27. Lenny Curry was next with 25 percent, followed by Bill Bishop at 11 percent and Omega Allen at 2 percent. The remaining 25 percent said they didn’t know who they’d vote for or refused to answer. Broken down by parBrown: 37% ties, Brown fared better with Democrats (63 percent) and no party affiliates (29 percent) while Curry brought in the majority of Republicans (47 percent). The margin of error for the poll is plus or minus 4 percentage Curry: 25% points. Questions asked of the likely voters also showed insights into Brown’s approval rating and whether both he and Curry were seen as strong leaders and how much they cared about people. The majority of those Bishop: 11% polled, 55 percent, said they either strongly or somewhat approve of the job Brown has done during his first term. City Council member Denise Lee, chair of the Special Ad Hoc Committee on Jacksonville’s Neighborhood Blight, said the campaign is the culmination of a year of work. The committee also helped form a new city mowing and landscape division and established a series of illegal sign and used tire buy-back events. A new mobile app, MyJax, is available for Apple and Android devices that residents may download and use to document and report illegal dump sites, overgrown grass and litter. The app works with a smartphone’s GPS capability and delivers an image and the location of the problem directly to 630-CITY, the city’s call center. Paul Martinez, director of IntraGovernmental Services, said the app will make it easy for people to notify the city about problems and make it easier for the city to quickly address issues. The app includes a schedule of solid waste and hazardous waste collection events. Another feature allows residents to schedule pickups of appliances and discarded furniture. The Jacksonville Transportation Authority will feature the campaign and the app in an advertisement on a bus. Nathaniel Ford, authority CEO, said in addition to donating the rolling billboard, trash cans have been installed at more than 120 bus stops in an effort to reduce litter in neighborhoods. A year later the community unveiled an $8 million “rolling hills” golf course, designed by famed golf course architect Tom Fazio, followed by a $10 million clubhouse in the fall. Then, the recession hit. The company hunkered down. “We said, ‘Let’s make sure nothing slips and be ready when the market starts to show life again,’” said David Haas, ICI Homes’ chief development officer. Home sales continued, slowly. So far, about 150 have been built. As recovery took hold at the Beaches and in St. Johns and Clay counties, Nassau waited. Last year home construction starts in the county climbed to 400. But there are still nearly 3,000 vacant and developed lots on the ground — almost an eight-year supply, according to industry analyst Metrostudy. ICI Homes saw something different in 2014. “Our sales have crept up every year,” Messina said “But, it was this last spring that we said, ‘Aha, we see the light at the end of the tunnel, let’s get ready.’” Their instincts proved right. In Nassau County, a place where the housing recovery so far has lagged, at least one builder is betting on a turning of the tide. ICI Homes on April 15 will open an eight-court tournamentstyle tennis complex at Amelia National Golf & Country Club, a gated development in Fernandina Beach where the company is managing partner. The builder also opened a model home March 5. It’s a $250,000 investment in a community that has seen just a trickle of growth since 2006. “We’ve started seeing traction to where we can say, ‘OK, it’s not a fluke,’” said Rosy Messina, vice president of Marketing for ICI Homes. “We felt it was time to invest with brand new product.” When Amelia National first launched in 2005, the housing market was red hot. Lots were getting pricy in Duval County and developers were looking to the perimeter for land, including north into Nassau County. Amelia National, a golf community with 749 homes planned at build-out, opened in the spring were better than the previous 12 months. A year ago, Joe Mattingly, a tennis pro and 30-year tennis instructor who’d operated clubs in other communities, approached ICI Homes. He’d noticed there was no top-class tennis facility at Amelia Island. He wanted to bring one to Amelia National. The community already had three Har-Tru tennis courts for residents. Mattingly wanted eight, all with lights for evening play. Also, he wanted to operate the facility as a private club, where non-residents could be members and where tournaments between other clubs in the region could be held. ICI Homes struck the deal and began construction. In addition to the courts, Amelia National Tennis Center will include a pro shop staffed by four tennis pros. In terms of quality, the new facility will have peers in the market, for example the tennis center at the Omni Amelia Island Plantation Resort. The difference is it will be a true private tennis club, with no hotel guests, said Greg Brousse, Amelia National’s managing director. “This is for your tennis leagues and the members you go to play with,” he said. It’s the company’s most popular home design. “It’s all on one story and it lays out beautifully for entertaining,” Messina said. Amelia National lies along Amelia Concourse, a corridor that claims the lion’s share of new home construction in Nassau County. The Amelia Walk, Timberlake, Amelia Concourse and North Hampton communities all share the neighborhood. Until recent years, Amelia Concourse’s corner with Florida A1A had only a Murray’s Grill and gas stations. Today, Lowe’s and Home Depot have sprouted to the west and a Publix shopping center across the street is readying its second phase of development. But lawyers for the Legislature said Leon County Circuit Judge Terry Lewis acted appropriately last year when he upheld lawmakers’ second version of the map. The second map was drawn after Lewis found political consultants managed to “taint the redistricting process and the resulting map with improper partisan intent” the first time around. The arguments Wednesday were the latest chapter of a long- running battle between votingrights organizations like the League of Women Voters and lawmakers about whether congressional and state Senate maps violate the anti-gerrymandering Fair Districts amendments, approved by voters in 2010. The Senate maps were not discussed. Plaintiffs, who had initially hailed Lewis’ decision to strike down the first draft of the congressional map based on two districts he thought were problematic, later appealed when the judge accepted a redrawn plan that made few changes to those districts. But at least one member of the court’s more conservative minority was skeptical that Lewis’ ruling supported that claim. “Where is there a general finding that this whole map was the result of a partisan intent?” asked Justice Charles Canady. In the first ruling, Lewis struck down Congressional District 5, which winds from Jacksonville to Orlando and is represented by Democratic Congresswoman Corrine Brown of Jacksonville, and Congressional District 10, which is in the Orlando area and is represented by Republican Congressman Dan Webster. Those challenging the maps said the Legislature should have redrawn Brown’s district to run from east to west, instead of continuing to run north to south. The NAACP, however, filed a brief backing the current configuration because the civil-rights group fears an east-west map could hurt the ability of AfricanAmericans to elect a candidate of their choice in that district. Page A-4 • Thursday, March 5, 2015 • Financial News & Daily Record Scott drops fight over welfare drug testing After spending at least $300,000 of taxpayer money on legal expenses, Gov. Rick Scott is abandoning his fight to force welfare applicants to undergo mandatory drug tests. A federal appeals court ruled in December that the state’s mandatory, suspicion-less drug testing of applicants in the Temporary Assistance for Needy Families, or TANF, program is an unconstitutional violation of Fourth Amendment protections against unreasonable searches and seizures by the government. Tuesday was the deadline for Scott to ask for an “en banc” review from the full 11th U.S. Circuit Court of Appeals, which upheld previous court decisions that the Florida law is unconstitutional, or to file an appeal with the U.S. Supreme Court. “We chose not to appeal this case. The governor is continuing to protect Florida children any way he can and create an environment where families can get jobs so they are able to pursue their dreams in safe communities,” Scott spokeswoman Jackie Schutz said in a statement Wednesday evening. The American Civil Liberties Union, which filed the challenge on behalf of single father and Navy veteran Luis Lebron shortly after the law went into effect in 2011, hailed the end of the drawnout legal battle over the drug tests, an issue Scott campaigned on during his first bid for governor in 2010. “This law was always about scoring political points on the backs of Florida’s poor and treating them like suspected criminals without suspicion or evidence. It not only offended the dignity of families who are struggling to get by and need temporary assistance, but it also offended constitutional protections against invasive government searches,” ACLU of Florida Executive Director Howard Simon said. In December’s 54-page opinion authored by appeals-court Judge Stanley Marcus, the Atlanta-based court rejected Scott’s arguments that the drug tests are needed to ensure that children in poor families grow up in drugfree homes. The state also argued that TANF applicants would give up privacy rights by consenting to urine tests to be eligible for benefits. The law “offends the Fourth Amendment,” Marcus wrote, and relied on the state’s own evidence showing that, during the short time that the law was in effect, fewer than 3 percent of TANF applicants tested positive for drugs. “Of course, citizens do not abandon all hope of privacy by applying for government assistance. By virtue of poverty, TANF applicants are not stripped of their legitimate expectations of privacy — they are not employees in dangerous vocations or students subject to the (power) of the state,” Marcus wrote. Scott, however, has not totally abandoned a separate effort to drug test state workers. The governor was forced to capitulate on an executive order requiring all state employees to submit to urine tests. The federal appeals court ruled last year that Scott could not constitutionally justify drug testing for all types of state workers without a reason. Scott and lawyers for the ACLU of Florida, which represents the state workers’ union, haggled for months before reaching consensus on classes of jobs that could be eligible for the tests. The U.S. Supreme Court this summer refused to hear an appeal in the case, which is pending before a federal judge in Miami. 15 percent said they didn’t and the vast majority, at 62 percent, didn’t know or refused to answer. For the question about whether Curry “cares about people like you,” 36 percent responded affirmatively, 15 percent negatively and 49 percent said they didn’t know or refused to answer. Voters also were asked to put the three frontrunners on a fivepoint ideological scale, rating from very liberal to very conservative. Most said Brown was moderate, 29 percent, or slightly liberal, 27 percent. Curry was seen as very conservative, 22 percent, or slightly conservative, 16 percent. And the overwhelming majority, 66 percent couldn’t or wouldn’t answer about Bishop. The UNF poll also took a look at the sheriff’s race, which has seven candidates in the running. Ken Jefferson led the way with 24 percent, followed by Mike Williams at 16 percent, Jimmy Holderfield at 10 percent, Jay Farhat at 7 percent, Tony Cummings and Rob Schoonover at 4 percent, Lonnie McDonald at 2 percent and “someone else” pulling 1 percent.
